Key Amendments to the BCEA Leave Provisions:
1. Parental Leave:
• Entitlement: Employees are entitled to 10 consecutive days of unpaid parental leave.
• Commencement: This leave can be taken from the day the employee’s child is born, the date an adoption order is granted, or the day a child is placed in the care of a prospective adoptive parent pending the finalization of an adoption order.
• Note: This provision replaces the previous entitlement of three days of family responsibility leave for the birth of a child.
2. Adoption Leave:
• Entitlement: An employee who is an adoptive parent of a child below the age of two is entitled to 10 consecutive weeks of unpaid adoption leave.
• Commencement: This leave starts on the date an adoption order is granted or when the child is placed in the care of the prospective adoptive parent by a competent court, pending the finalization of the adoption order.
• Dual Parents: In cases where two parents are adopting, one parent may take adoption leave, while the other is entitled to parental leave.
3. Commissioning Parental Leave:
• Entitlement: An employee who is a commissioning parent in a surrogate motherhood agreement is entitled to 10 consecutive weeks of unpaid commissioning parental leave.
• Commencement: This leave begins on the date the child is born.
• Dual Commissioning Parents: If there are two commissioning parents, one may take commissioning parental leave, and the other may take parental leave.
Additional Considerations:
• Family Responsibility Leave: Apart from the birth of a child, employees remain entitled to three days of family responsibility leave per annual leave cycle for circumstances such as the illness of a child under 18 or the death of a specified family member.
• Unpaid Leave and UIF Claims: The newly introduced leaves—parental, adoption, and commissioning parental leave—are unpaid. Employees can apply for benefits from the Unemployment Insurance Fund (UIF) during these periods.
